In the event of default, Deloa Energy, after the payment deadline for invoices has passed, may place the customer in default, as provided for by TIMOE and TIMG, by means of a communication sent by registered letter with return receipt or certified email containing the payment deadline. Once payment has been made, the customer is required to promptly send the relevant documentation to Deloa Energy by email to payments. <\/span><\/i>info@deloaenergy.it.<\/span><\/i><\/a> The notice of default also serves as advance notice of service suspension.<\/span><\/i><\/p>\n

After no less than 3 working days from the final payment deadline indicated in the notice of default, in the event of continued default, and subject to cases expressly provided for by provisions issued by the competent authorities, Deloa Energy reserves the right to request from the SII, where technically possible, the suspension of electricity supply, pursuant to TIMOE, for one or more PODs, or from the distributor the closure of one or more PDRs for suspension of natural gas supply due to default pursuant to TIMG.<\/span><\/i><\/p>\n

With regard to electricity supply, where the technical conditions of the meter allow, after 25 calendar days from the date of notification of the notice of default, the distributor will proceed, before suspending the supply, to reduce the power to a level equal to 15% of the available power. After a further 15 days from such reduction, in the event of continued default, the supply will be suspended.<\/span><\/i><\/p>\n

Where it is not possible to proceed with suspension of supply, Deloa Energy may in any case request from the distributor, where the conditions of technical feasibility exist, the interruption of power to the PODs and PDRs. <\/span><\/i><\/p>\n

Supply may not be suspended where the amount of non-payment is less than or equal to the amount of the security deposit or equivalent guarantee applied and, in any case, when it is less than an amount equivalent to the estimated average amount relating to one billing cycle.<\/span><\/i><\/p>\n

Once supply has been suspended, the customer wishing to obtain reactivation must send to Deloa Energy documentation certifying full payment of the amounts indicated in the notice of default. Before proceeding with the reactivation request, Deloa Energy reserves the right to await actual crediting of the amounts due. The costs relating to the notice of default, the costs of suspension and reactivation of supply within the maximum amount provided for by ARERA, as well as the costs of any activities connected with debt recovery, will be borne by the customer and charged on the first subsequent invoice. <\/span><\/i><\/p>\n

In any case, following suspension of supply and in the event of continued non-compliance by the customer, Deloa Energy will have the right to declare the contract terminated and send the relevant termination notice to the SII, which will take effect from the date indicated therein.<\/span><\/i><\/p>\n

In cases of suspension for default or power reduction not preceded by sending the notice of default or without observance of the deadlines provided for by TIMOE and TIMG (in particular, the final deadline for payment, the minimum deadline for suspension running from sending the notice of default and the minimum period between the final payment deadline and forwarding the suspension request to the SII or distributor), the customer will be entitled to the automatic compensation provided for by TIMOE and TIMG, namely:<\/span><\/i><\/p>\n
